TERMS AND CONDITIONS OF SALE

1. INTRODUCTION

These General Terms and Conditions of Sale (hereinafter "GTC") govern the terms of sale between the company Biscuiterie de Nioulargo and the Customer, within the scope of a remote online and mobile sales system, relating to the goods defined in the sales catalog of the website and mobile application (hereinafter "the Site"). Acceptance of these GTC is required for any order placed on the Site.

2. ORDER PLACEMENT

The Customer can make a purchase as a guest or must create a Customer Account by providing an email address and a password, which must be kept confidential. The order must be accurately filled out with the requested information. The Customer agrees to complete the order form accurately and provide the various required details (full name, billing and shipping address, payment method, etc.). After payment, they will receive an email confirming the details and terms of their order. The order becomes valid only when all the requested information is provided by the Customer. The Customer receives a confirmation email after payment, confirming the order details. By clicking on the payment icon, the Customer acknowledges full acceptance of the GTC.

3. PRODUCTS AND ORDERS

The products presented on the Site are available within the limits of stock availability. Each product is accompanied by a photograph and a description. Visuals are indicative and not contractual.

The internet user expressly acknowledges and accepts that:

4. PRICES

The prices indicated are in euros, all taxes included (VAT included). The applicable French VAT on the day of the order is included. Delivery costs are charged separately. Prices cannot be changed once the order is confirmed.

Prices and fees are subject to change or fluctuation based on raw material prices and the market in general. The company reserves the right to increase its prices. Shipping costs include the expenses of quality packaging ensured by the company.

5. PAYMENT METHOD

Payment is made by credit card (CB, VISA, MASTERCARD, AMEX) online from the Site. Payment is immediate.

6. RIGHT OF WITHDRAWAL

In accordance with the law, the right of withdrawal does not apply to perishable, food products sold on the Site. For other products, the Customer has fourteen (14) days from the receipt of the product to exercise their right of withdrawal with the company.

7. DELIVERY

The company Biscuiterie de Nioulargo ensures the delivery of the ordered products, respecting the deadlines indicated during the order. The Customer is responsible for the provided delivery information.

The company ensures the merchandise up to the delivery location, or otherwise stated as a "Pick up" in their store. The risk of transportation is borne by the buyer. It is the recipient's responsibility to check shipments upon arrival and to make any justified reservations, or even to refuse the package if it appears to have been opened or shows signs of damage.
Finally, if the product, under the responsibility of the courier, has not been delivered due to reasons such as customs, strikes, damages, or any other force majeure cause as defined by the courts, the sale may be resolved, and the Customer may obtain a refund of the price excluding any other compensation or damages.
In case of non-delivery for reasons beyond the company's control, no refund will be made.

8. INTELLECTUAL PROPERTY

All elements of the Site are the intellectual property of the company Biscuiterie de Nioulargo. The structure, layout, graphic design, texts, database, images, photos, sounds, videos, and any other elements composing the Site are and remain the intellectual and exclusive property of the company and are protected by copyright. Reproduction, redistribution, or use in any form, even partial, of the elements of the Site are subject to the express and prior authorization of the company.

9. PERSONAL DATA PROTECTION

10. DISPUTES AND APPLICABLE LAW

Any dispute will be subject to the exclusive jurisdiction of the Commercial Court of Fréjus. The GTC are governed by French law.

11. INDEPENDENCE OF CLAUSES

If a clause of these GTC is declared unenforceable, the other clauses remain valid.

12. FORCE MAJEURE

No party shall be held responsible for non-performance due to a case of force majeure.

13. MODIFICATION OF GTC

The company Biscuiterie de Nioulargo reserves the right to modify these GTC at any time.
